Contracting a marriage between Polish citizens and foreigners

 

Persons who wish to contract a marriage are obliged to present the Head of the Registry Office the following documents:

  • Document confirming the identity (for example identity card, temporary certificate of identity and passport),
  • Summary copy of a birth certificate,
  • Written statement confirming that there are no circumstances excluding contracting a marriage,
  • A foreigner who wishes to contract a marriage, except above mentioned documents, shall also submit a document confirming that, according to a law of his/her country of citizenship, he/she has legal capacity to contract a marriage (so called certificate of a single state). If obtaining such certificate meets with any obstacles, a court, at a foreigner’s request, may release him/her from submitting such document.
  • Receipt of payment of stamp charge.

 

 

Contracting a civil marriage

Statements shall be made in the presence of two adult witnesses. Contracting a marriage can be made in any Registry Office chosen by persons wishing to contract a marriage.

In justified cases, the Head of the Registry Office may take statements beyond the registry Office.

 

Remarks:

  1. Persons who wish to contract a marriage are obliged to submit written statements confirming that there are no circumstances excluding contracting a marriage. A statement can be submitted before any Head of the Registry Office in country, and before Polish counsel or public notary abroad. A foreigner who does not speak Polish, shall submit such statement in the presence of sworn interpreter.
  2. Contracting a marriage shall be made in accordance with the provisions of family and custodial code.
  3. In the day of contacting a marriage fiancée and fiancé and their adult witnesses shall present documents of identity. If one of above mentioned persons do not speak Polish, a marriage is contracted in the presence of sworn interpreter.

 

Contracting a marriage between Polish citizen and a foreigner who stays in the arrest for the purpose of expulsion or in the guarded centre

   

1. With regard to a place of residence of a foreigner:

  • Arrest for the purpose of expulsion (Warsaw Okęcie) – an application to the commanding officer of the Border Guard for giving a consent to contract a marriage on the territory of arrest.
  • the Guarded Centre in Przemyśl – an application to the manager of a centre for giving a consent to making room accessible in order to contract a marriage on the territory of the centre.
  • other guarded centres for foreigners – application to the manager of a centre for giving a consent to contract a marriage on the territory of the centre.

 

  2. Verification if a marriage was not contracted in order to avoid the provisions on expulsion conducted by Border Guard.

 

  3. Submitting proper documents in the Registry Office.
